AN ACT
to amend the racing, pari-mutuel
wagering and breeding law, in
relation to the non-profit racing
association oversight board
The People of the State of New
York , represented in Senate and
Assembly, do enact as follows:

1 Section 1. Subdivisions 1 and 2 of section 208-b of the racing, pari-
2 mutuel wagering and breeding law, as added by chapter 354 of the laws of
3 2005, are amended to read as follows:
4 1. [There is hereby created a non-profit racing association oversight
5 board consisting of five members appointed by the governor, herein
6 referred to in this section as the board. Of the five members, one shall
7 be appointed upon the recommendation of the temporary president of the
8 senate and one shall be appointed upon the recommendation of the speaker
9 of the assembly. Each member shall serve for a term of four years. The
10 governor shall designate the chair from among the sitting members who
11 shall serve as such at the pleasure of the governor.
12 2. The members shall serve without compensation for their services as
13 members , but shall be entitled to reimbursement for actual and necessary
14 expenses incurred in the performance of their duties.] There is hereby
15 created a corporation to be known as the non-profit racing association
16 oversight board, herein referred to in this section as the board. Such
17 board shall be a body corporate and politic, constituting a public bene-
18 fit corporation. The board shall consist of five members appointed by
19 the governor. Of the five members, one shall be appointed upon the
20 recommendation of the temporary president of the senate and one shall be
21 appointed upon the recommendation of the speaker of the assembly. Each
22 member shall serve for a term of four years. The governor shall desig-
23 nate the chair from among the sitting members who shall serve as such at
24 the pleasure of the governor.
25 2. The members shall serve without compensation for their services as
26 members , but shall be entitled to reimbursement for actual and necessary
27 expenses incurred in the performance of their duties. The state shall
28 save harmless and indemnify members of the board and any officer,

1 employee, agent or other person or persons pursuant to section seventeen
2 of the public officers law against any claim, demand, suit or judgment
3 arising by reason of any act or omission to act by such member, officer,
4 employee, agent or person occurring in the discharge of his or her
5 duties and within the scope of his or her service on behalf of the
6 board .
7 § 2. This act shall take effect immediately and shall be deemed to
8 have been in full force and effect on and after April 1, 2005 provided
9 that the amendments to section 208-b of the racing, pari-mutuel wagering
10 and breeding law made by section one of this act shall be repealed on
11 the same date as such section is repealed pursuant to chapter 354 of the
12 laws of 2005, as amended.
