A BUDGET BILL submitted by the Governor
in accordance with Article VII of the Constitution
AN ACT to amend chapter 62 of the laws of 2003, amending the general business law and other laws relating to implementing the state fiscal plan for the 2003-04 state fiscal year, in relation to the school tax relief fund; and to amend chapter 474 of the laws of 1996, amending the education law and other laws relating to rates for residential health care facilities, chapter 1 of the laws of 2002, amending the public health law, the social services law and the tax law relating to the Health Care Reform Act of 2000, in relation to extending certain provisions thereof
Purpose: This bill amends legislation enacting the 2003-04 budget, to ensure adequate funds are available to meet the purposes of the School Tax Relief Fund and amends the Public Health Law and other laws regarding Medicaid-financed shares between the State and localities.
Summary of Provisions: Section one of this bill amends Chapter 62 of the Laws of 2003 to increase by $40,000,000 the amount of funds the State Comptroller is authorized and directed to transfer into the School Tax Relief Fund from amounts collected pursuant to Article 22 of the Tax Law.
Sections 2 through 7 make technical revisions to Chapter 474 of the Laws of 1996, as amended by Chapter 433 of the Laws of 1997, to amend the Public Health Law with respect to Medicaid-financed shares between the State and localities.
Section 8 provides that the bill shall take effect immediately and be deemed to have been in full force and effect on and after April 1, 2003.
Existing Law: This is a new bill.
Statement in Support: Enactment of this bill is necessary to provide funding for liabilities occurring in the 2003-04 fiscal year that exceed the budgeted resources.
Budget Implications: The provisions of this bill are accommodated in the current Financial Plan for 2003-04.
